Agency

CAPITAL EXPRESS TRAVEL PTY LTD is a licensed Australian Travel Agent and a member of the Travel Compensation Fund. CAPITAL EXPRESS TRAVEL PTY LTD’s ATAS Accreditation Number A13226 and its AFTA Member number is 10242.

General

We sell various travel related products on behalf of numerous transport accommodation and other service providers such as airlines hotels resorts tour companies and cruise line operators. CAPITAL EXPRESS TRAVEL PTY LTD’s obligation is to make travel bookings on your behalf and to arrange relevant contracts between you and travel service providers. We have no responsibility for these services nor do we make or give any warranty or representation regarding their standard. All bookings are made subject to the terms and conditions and limitations of liability imposed by these service providers. Your legal recourse is against the specific provider and not CAPITAL EXPRESS TRAVEL PTY LTD. If for any reason any travel service provider is unable to provide the services for which you have contracted your remedy lies against the provider and not with CAPITAL EXPRESS TRAVEL PTY LTD.

We highly recommend travel insurance.

All air fares quotes are valid only for the day that the quote is provided and are subject to price changes imposed by airlines. Many fares contain restrictions and fees regarding changes and cancellation. Please check with your CAPITAL EXPRESS TRAVEL PTY LTD Consultant for the Terms and Conditions of this ticket. In addition to any fees charged by airlines, wholesalers & suppliers, CAPITAL EXPRESS TRAVEL PTY LTD cancellation fee will apply. If you cancel before full payment a cancellation fee equal to your deposit and subsequent payments will be charged.

Each travel booking is made with understanding that all passengers listed in the booking have no impediment to entry to transfer points or all destinations within this booking. Any refusal/cancellation of entry due to non-compliance or for any reason shall be responsibility of passengers within this booking. Emailed copy of the bookings will be deemed that it has been read understood accepted for ticketing.

All flights need reconfirmation 72 hours prior to departure. Check-in time for international departures is 3 hours prior to departure all flights are subject to change without notice. Please ensure you are travelling with a valid passport with at least 6 months validity upon return to Australia. Please check if a visa is required for your travel destination and a maximum stay applies to your ticket. For the USA obtain ESTA before purchasing ticket. For advice on travel health issues please contact your local doctor.

Transportation and other services provided by the carrier are subject to conditions of contract and other important notices. In addition to these is the advice to international passengers on limitation of liability. For your copy of these term and conditions please contact your airline directly or ask for a copy of them at checkin.

Visas and Passport

Many (international) destinations require the issue of visas before you travel. A visa provides you with the authority as a non-citizen to travel to another country. Visas are obtained from the issuing authority in Australia, usually an embassy. Visa requirements vary both by the country you are travelling to and the current citizenship you hold, so please ensure you check well in advance of your travel dates to allow sufficient processing time as required by the embassy. It is your responsibility to ensure you have valid visas and re-entry permits which meet the requirements of immigration and other government authorities. Any fines, penalties, payments and expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility. You must ensure that you double-check dates and applicability when your Visas arrive because mistakes can be made by issuing countries.

All individuals departing from Australia must be in the possession of a valid passport. If your passport is due to expire within six (6) months of your return to Australia, then under normal circumstances you should obtain a new passport. However, this is often variable depending on the country you visit.

Please ensure that you have a valid passport well in advance of travel as either the airline staff or immigration authorities will not allow you to pass through customs and board your flight without this documentation.

The Australian Department of Foreign Affairs and Trade provides helpful information on applying for or renewing an Australian passport. A website available for travellers to obtain up to date information is at http://www.dfat.gov.au/travel/index.html

Credit Card Payments

You consent to us supplying your billing, payment and identification information to third parties with whom you enter into transactions. We may also provide such personal information to third parties as is required to complete your booking.

You authorise us to disclose your credit card details to, and obtain information from, any financial institution or credit card issuer to verify the credit card and identification details that you provide. You also authorise your credit card issuer or financial institution to verify that the credit card and identification details you have provided to us are accurate.

You authorise us to take steps to confirm that there is sufficient credit on your credit card account to meet likely charges. For any payment by credit card, airline tickets will not be issued until authorisation has been obtained from the relevant card company. You authorise us to charge all fees incurred to the credit card designated by you. If payment is not received from the card issuer or its agents for any reason, you agree to pay us all amounts due on demand. Confirmed bookings are subject to your credit card approval for the transaction. Where your purchase by credit card is not approved, we will attempt to contact you but CAPITAL EXPRESS TRAVEL PTY LTD is not responsible for any subsequent non-provision of services in the event we are unable to establish contact with you.

CAPITAL EXPRESS TRAVEL PTY LTD reserves the right to charge administration/service fees for payments made by credit card. These charges are up to 3.5%. These charges will appear on the review page of the on-line booking process. Credit Card payment debit may take up to 72 hours after a booking is made online.

Credit card surcharges apply when paying by credit card. If for any reason any travel service provider is unable to provide the services for which you have contracted, your remedy lies against that provider and not against CAPITAL EXPRESS TRAVEL PTY LTD. In the event that payment has been made to CAPITAL EXPRESS TRAVEL PTY LTD by credit card, you agree that you will not seek to claim back from CAPITAL EXPRESS TRAVEL PTY LTD any credit card surcharges.

Online Bookings

Bookings made online are only for Ex Australia, we hold the right to reject online bookings if we believe that they are not genuine bookings or are fraudulent. Some online fares will incur a booking fee or service charge. We hold the right to ask you for further information regarding your credit card when purchasing online. This may include a photocopy of your passport or drivers license and credit card that you are paying with. We hold the right to refuse your booking including and your payment. Credit Card name must match passenger name travelling, the airline may ask the credit card used for booking during check-in.

Amendments and Cancellation Fees

Changes and cancellations made to all airline tickets/bookings, cruise, holiday packages, tours, accommodation or any other product purchased from CAPITAL EXPRESS TRAVEL PTY LTD will incur admintration fees plus any airline fees and wholesaler/supplier administration charges

Any changed or cancelled bookings will also incur wholesaler/supplier fees, which can be up to 100% of the cost of the booking, regardless of whether travel has commenced. Supplier fees may also apply where a booking is changed and when tickets or documents are re-issued. Where we incur any liability for a supplier cancellation fee for any booking which you change or cancel, you agree to indemnify us for the amount of that fee. Where you seek a refund for a cancelled booking for which payment has been made to the supplier, we will not provide a refund to you until we receive the funds from that supplier.

All fees are applicable per person and per ticket or travel voucher.

Reissue Fee:

If any ticket has been issued that requires a change, for example to a date, a reissue fee will apply, at a fee of $150 per change per person plus any airline incurred fees and wholesaler/supplier administration charges.

Cancellation Fee:

All cancellations are governed by the terms and conditions of the airlines booked for services. After confirmation, any cancellation of any component of your travel package will incur a $150, inclusive of GST, per person and per ticket/travel voucher cancellation fee levied by CAPITAL EXPRESS TRAVEL PTY LTD plus any plus any airline incurred fees and wholesaler/supplier administration charges.

Refund Fee:

The fee incurred is $150 per person and per ticket inclusive of GST, plus any airline incurred fees and wholesaler/supplier administration charges. Your request for a refund of a booked airfare is governed by the terms and conditions of the airline from which you have purchased the airfare and is made or not made as determined by the airline. Many fares are non-refundable. Airline charges or cancellation fees may apply to your particular airfare. Where a refund is applicable, the turnaround time from the date of your request for refund to the date you are provided with your refund may take up to 12 weeks.

Lost Ticket Fee:

The fee incurred is $150 per ticket inclusive of GST, plus any airline incurred fees and wholesaler/supplier administration charges. Tickets misplaced/lost by passenger must be fully paid for even when they have been lodged for a Refund/Lost Ticket Indemnity with the relevant airline. Tickets submitted for refund must not be deducted from or offset against invoices; they will be submitted as per normal refund procedure.

Amendment Fee: Each amendment will incur a minimum fee of $150 (inclusive of GST) plus any airline incurred fees and wholesaler/supplier administration charges.

Validity of Prices

CAPITAL EXPRESS TRAVEL PTY LTD strives to ensure that all information available on our website is accurate; however the prices & information on the CAPITAL EXPRESS TRAVEL PTY LTD web site and featured in the booking engine are supplied by Third Parties and are subject to availability and conditions and are subject to change without notice. Although every care has been taken, the prices are not guaranteed until paid in full and documents have been issued. All pricing is reflected in Australian Dollars (AUD) unless otherwise specifically denoted on the screen.

Unless indicated, prices do not include, items of a personal nature (such as telephone calls, alcoholic beverages, gratuities, etc.), transport, home port to destination and return.

Duplicate Bookings

If you are holding a duplicate reservation with another travel agent or the airline, the airline/wholesaler/supplier system can automatically cancel all reservations even after the ticket has been issued.

We take no responsibility for any reservation or ticket cancellations caused by your duplicate bookings. Fees will apply for creating a new reservation and issuing new tickets. It is your responsibility to remove all duplicate reservations.

Taxes

Government tax, airport charge, fuel surcharges are current at time of booking but are subject to change without notice.

Airport and departure taxes are not included in the airfare, or included within the Government taxes or airport charges. Additional departure taxes may be applicable at some airports and payable in the local currency directly on departure.

Health / Vaccinations

It is your responsibility to ensure that you are aware of any health requirements for your travel destination and to ensure that you carry all necessary vaccination documentation.

Frequent Flyers

If you are a member of an airline’s frequent flyer scheme, please ensure that you have provided or entered your correct number in the special section featured in the booking engine at the time of booking. CAPITAL EXPRESS TRAVEL PTY LTD will not take responsibility if the airlines do not register your trip. You are advised to retain copies of your air ticket and boarding pass.

Liability

We do not endorse or recommend any particular travel service provider, nor do we vouch for the accuracy or completeness of the information provided by third parties in relation to their products and services. Information provided is provided in good faith, and is subject to amendment at any time without notice. You should make your own evaluation of the accuracy or completeness of any information, opinion, advice or other content available.

We are not liable for any inconvenience caused or expense incurred as a result of any unsuitability or non-provision of travel services for use in association with other travel services except to the extent that liability in relation to those matters may be imposed on us by legislation that cannot be excluded. Our role in relation to your travel arrangements is limited to facilitating your booking and arranging travel documentation, payments and refunds as applicable.

We do not accept any liability of whatever nature, whether in contract, tort or otherwise, for the acts, omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control.

In circumstances where liability cannot be excluded, such liability is limited, in each instance, to the value of the purchased travel arrangements.

Amendments to Terms and Conditions

We reserve the right to amend these terms and conditions from time to time. Amendments will be effective immediately upon notification on this web page. Your continued use of the website following such notification will represent an agreement by you to be bound by the terms and conditions as amended.
